Still not too late to apply for an H-1B (http://www.fongandchun.com/lawyer-attorney-1477281.html). New H-1B quota figures as of September 10, 2010:
Out of the 65,000 cases that can be approved for H-1B this year, 37,400 cases have been receipted by USCIS for the regular Bachelor's degree H-1B quota. This is up from 36,600 cases which were received since September 3, 2010.
Approximately 13,700 cases have been receipted by USCIS for the advanced degree H-1B quota, a slight increase of about 300 cases filed since September 3, 2010 when approximately 13,400 cases had been received.
October 1, 2010 is around the corner. People with newly approved H-1Bs will soon be able to begin employment. First time applicants can still continue to submit applications for H-1B status until the entire H-1B quota is exhausted. I'll keep you updated on the cap count, so check back soon. ---ecf

We are getting ready to file for another H1B extension, and based on work location, will have to file with the Vermont Service Center. The employer is NOT cap-exempt, but I have had an H1B for many years (so do not need to file for new visa). I am not sure which is the correct address for filing, though. (See p. 20, I-129 instructions.) I think we need to use:
All other I-129 Cases:
USCIS
Vermont Service Center
ATTN: I-129
75 Lower Welden Street
St. Albans, VT 05479-0001.
(Other option:
H-1B Cap Cases:
USCIS
Vermont Service center
ATTN: H-1B Cap

hi,
I have approved labor & I-140 with my employer and they filed for my H1B extension. If i would like to change the employer, what is the process i should go through with new employer regarding my GC? will they have to apply labor again for me or can they use this approved labor & I-140 and continue my GC from then so that i will not lose my priority date? If they cannot use my labor, is there any other way to use my priority date.Please advise on how to proceed...

I checked online in my bank and my uscis checks have passed for i-485,i-131,i-765. On the back of the checks, i found receipt numbers, I correctly took all receipt numbers and i entered them to my profile on uscis.gov website to track the processing, & !Surprise! i saw two receipt numbers referring to I-131and one to i-765 whereas none for i-485, Ideally, out of 3 receipt numbers, it should be one for each of i-485,i-131 & i-765??????? Don't know what to do? Has any one heard anything like that???????????????

Hi All,
My employer has filed for ETA 9089 and it is approved. I am paying for the green card processing. Before applying for I-140 he asked me to sign a memorandum which states that I am bearing the complete expenses of the process (filing fees of I-140 , I-485 and $500 extra) . It also states that I need to be with the company for 6 months from the time green card is approved. In case I leave the company prior to 6 months for whatsoever reason, I need to pay $15000 as damaging charges to company.
He says that signing this memorandum is mandatory otherwise he will not file I-140.
My questions is , Is it legal to bind an employee to these conditions and ask processing fee to file Green card ? Also are these documents valid from legal perspective ?
Please let me know your thoughts on this. Appreciate it.

I am a Java Developer and I think my company would have filed my labor as a Programmer Analyst. Now I am planning to change my career into SAP functional analyst in financials. I even got a offer from a client and I think their job title and description definitely different.
1) Once I leave my current employer, should I need to work on same job profile or only at the time of GC interview I should have a offer from any employer with same job title & description? (assuming GC will take another 2 or 3 years for me to get and If I work these 2 or 3 years on different job title & description and produce a offer letter with same job title & description from a new employer at the time of GC interview)

I have a certain labor category approved 19-#### and AOS is applied . Now the job I am looking at moving to has the same number (19-####) but the job duties are not exactly same. Will this be OK for AC21 or will I have problems?

with supervisors of the CRU to find out what is going on with these cases
and if they can be routed to exams to be worked".
What does it mean ? What is happening in CRU ?
Internet refers CRU handles if case has multiple "A" nos or receipt notice delays....I filed only one I-485 application five years back.....

I got conflicting answers for this questions so I thought it would be best to post my question here.
This is the scenario
Company A
I am filing green card with this company based on **FUTURE EMPLOYMENT**
LABOUR APPROVED,I-140 PENDING,PRIORITY DATE : JAN 2009
Company B (Present Employer)
Labor Approved (Priority date : Aug 2009)
Now the question is Can I NOW file 140 with company B before my company A I-140 gets approved...?
In this case will I be able to use my Jan2009 priority date after my pending company-A I-140 gets approved..??
Note: I wanted to file 485 ONLY WITH COMPANY B

Hi all,
I have been fortunate enough to get one step closer to a green card.
I need to fill out form 230 and Line 25 asks to list all visits to or residence in the US.
I have been living in the US for the past 7.5 years. Can I just list my residences and corresponding visas or do I have to list all visits? :confused:
I have a fair number of visits, as I have been travelling both for work and leisure in the past few years. I have most of the entry/exit stamps, but there are a few missing. So I am wondering if there will be a problem when I list the visits and some of the dates cannot be supported with passport stamps.
Can anyone please advise if listing my residence will suffice (although this is already requested in line 20)?
btw I got my notification June 4, EU00006xxx

I am an employee of a company which was recently raided by uscis. My 6th h1 expires April 2009 and we applied for 7th year h1 extension based on
the approved labor (labor filed in March 2008).
I am not sure at this stage, that my h1 will get approved since the company is under the scanner.(I checked the LCA and It shows the work location where I am working and not from IOWA which is good)
So..what are my options now
1) Can any other employer file for extension based on this company's approved labor?.
2) If I join the other company, what documents do I need to show to USCIS that the labor is approved from my old company(the company under scanner)?
Please let me know..what you guys think...Any help will be greatly appreciated
