Guys, My labor was moved to Dallas Backlog center and got approved in 2006. When I searched its detail in files from flcdatacenter.com, I could not find any labor that matches my ETA number. I am not sure if there is any way to get the details. Though, online status site of Dallas backlog center shows the status but without any usable details. My labor's ETA number starts with D-xxxxx-xxxxx. Does any body has similar ETA number ?

I think people who haven't applied for their green card until now won't ever be able to do so....DOL won't ever make PERM certifications easier.

People, I see my RD, ND , A#, name on my I485 receipt. But I don't see my priority date PD mentioned on it. I am worried that this might delay my case processing. Anyone in the same boat as me

Thought this might be helpful to those who are planning to travel. You fill in your nationality, country of residence, destination country and connecting country and it will give your transit visa requirements in detail.

I have been married to a US Citizen for more than 6 years and my green card was issued 5years ago. My green card was issued thru marriage. On the N-400 application form for citizenship what should I use as my eligibility? marriage or being a lawful permanent resident for at least 5 years? Thanks :)

Currently I'm working for a major software firm (10,000+ employees) as a senior software engineer. My 6-yr H1-B expires by January 2010.
I filed for PERM with PD of October 2007 in Atlanta center under EB2 category for Sr.Software engineer position. As we know it is still in PENDING status after a AUDIT request.
Now, I have received an offer for a Sr.Technical Program manager internally in my company.
What are my options now?
1. Can I withdraw my current PERM (while it is PENDING after AUDIT) and apply for a new PERM under new position? OR
2. Can I use the same PERM since I'm staying with the same company?
3. Does the company size help in any way?

Yes, You can file for H1 extension and they will give you extension for the remaining period of 6 years.
FYI, total days of 6 years are counted based on your presence in US. so, even your out of US periods also can be recaptured.

Hi,
I'm on F1 visa and recently got married in US..I would like to have my lastname changed in my INDIAN passport.. I will apply for a new INDIAN passport through indian embassy in US..I realized that i will get a new passport with new last name...But my question is what happens to the F1 visa on the old passport and I-94, will they be still valid?...How does it work..what do i need to get them moved over to the new passport...
I know i will have to let my school know about the name change so that they can get me a new I-20 by updating the SEVIS...I've already done that and they are OK with it...

My wife is right now on H4 and having her EAD which will be expiring in another 2 months. She is not planning to work. Currently I am woking on H1B, soon I will be joing another employer on EAD. My question is it necessry for my wife to renew EAD even if she is not planning to use it. Once I swith on EAD what need to be done for my wife.

If I-485 is pending and the person is currently working on EAD with expired H1-B, is there a requirement that the person has to leave the country to apply for a new H1-B based on pending I-485? If yes, will it affect the green card process negatively?
My attorney says that as there was a gap in H1 status, one has to leave the country for a new H1 application, even though it is with the same employer.

I have an I-485 that will be current soon, but I am not employed. If they approve it, will that be considered a mistake and make it invalid? Should I withdraw it? Will a letter explaining the situation be sufficient? I have another application as a dependent, just takes longer.
Are you serious? Wait until your date become current and until then do not do anything. Instead of looking for ways to withdraw your I-485, why dont you look for ways to find a job that matches your I-140 skills, so that you can use AC21 portability.
You will never know when will you get your chance to file 485 again if you withdrew it.
