hi,
i entered the US on AP in Jan 2010, and at the time of entry, my I94 validity was set for
1 year (viz Jan 2011) - and the AP also noted "AoS" status on it.
(a) Is the validity of my I94 (and thus my legal stay) 1 year, or as i have read elsewhere,
if AoS is pending, then its valid till the AoS case is decided?
(b) If the validity is 1 year, what is the process for extending the I94 validity?

Hello,
These are my details :
I-140 -> Jul 07
I -485 -> Aug 07
I -140 Denied in may 08. There was no appeal no MTR
I-485 shows pending
New I 140 was filed in Jun 08, we got receipt information.
On that A# is same as the A# issued for I-485
Questions:
a) Is my I-485 still valid?
b) Is it tied to new I-140 we filed?
c) Can I renew my EAD and AP if I 485 is valid?
d) How to check all the 3 above?

Hello,
I have read in the popular immigration forums that one can request a one time 3 year extension to H1b beyond the standard 6 year limit if one has an approved I140 and could not file I485 due to retrogression. I am confused on how does one go about requesting this..meaning is it sufficient to just put three years under the 'date of intended employment' in I129 form and have a labor condition approval with similar dates or do you have to include a copy of approved I140 and point to the 2005 Aytes memo that grants such a provision while you file for I129. By the way the situation is also a bit more complicated due to the fact that I am changing jobs (5th year H1) and trying to get a 3 year transfer based on approval from the company I am leaving.

What happends if we don't get our checks cashed and no receipt after aug 17th, but the documents get returned.

I am the principal beneficiary and my husband is my derivative, however he got his fp (On july 12) and I haven't received mine!
Should I go with him and try to get fp? I am afraid they wont let me do it, because I only have the case #'s from the back of the checks, i dont have receipts yet!
The only thing we got so far is hi fp notice

If we are on H1 and able to file I-485(AOS) and continue to be on H1 until it expires. Then are we automatically on AOS after the expiry of H1? Or do we have to inform USCIS our intent to switch to AOS?
The reason I am asking this question is: I saw a case, although not similar, where the individual was on H1 and applied I-485 (inJuly 2007), he continued on H1 until it expired and decided to stay on h1 and so his employer applied for extension of H1 in 2009. At that time he received an RFE, the employer did not respond to the RFE. So, eventually the H1 Extension was denied.
After that USCIS denied his I-485 also. Reason give was: "Since the H1B EOS (Extension of Status) request was denied, it did not grant, or have the effect of granting, a lawful status during its pendency."
Please have your thoughts on this. Cause I am sure many of us have started using EAD, but did we transition the right way from H1 to EAD?

I applied for H1-b in 2008(I was in L1 when i applied).My employer never gave me my recipt number and i didnt even knw the status for a while ( though he said he applied without COS).Later he told it was applied with COS.
Later after numberous calls and mail he gave me a recipt number ,but the
status on USCIS website was "Notice Undelivered as of June 2008".
I could never find ,whether it was RFE or Approved status.I called up USCIS they said employer has to call to confirm the status.My employer said he will follow up with USCIS but he never did and he is absconding now .I cant reach him ,no phone,no mails.So i continued on L1.
Since my extension is coming up.I wanted to make sure my status hasnt changed because of this issue.
Has anyone faced this situation? Had that notice (undelivered) been an approval letter ,would that change my status though it was never accepted (Its undelivered as of Jun 2008)

My H1-B visa ended on December 31, 2009. I applied for a change of status to F1 visa on December 21st, 2009 towards the Spring 2010 (Jan 2010) semester. I received an RFE stating that I need to send a new I-20 for a valid future semester.
Assuming this new I-20 is for Summer 2010 (May 2010), my question is as follows - If my change of status to F1 gets approved and my semester starts 2 months later, am I allowed to legally stay in the country?

Very recently our company advertised for a position, this was for one of my co workers from China, company received over 200 resumes, I heard that the new rule is to reply to all the resumes and tell them why they dont qualify etc..

I am planning to go to India for emergency purpose. I have valid stampped H1B visa till Jan'2012 with my previous employer X. Now I have been working for new employer Y since Jun'2009. I have got approved 797 and have all paystubs since then. Do I need to go for visa stamping in India with new 797 or I should be able to enter US with my previous company's stampped visa?
Any quick reply is very much appreciated.

I m not sure but I think he has to wait till he gets his citizenship . The other way to apply for Tourist or student visa. Tourist visa will be for short time and student visa will be hard to get if the Husband is Green Card holder.

Last Friday was a depressing day for me. A businessman and his daughter visited me in my office. When I asked how they had learned about our law firm, they said a lot of flattering things about how "famous" we were and about our "great" website. I got my first H1B transfer through a lawyer. The lawyer charged $3500/- out of which approx $2500 has to be paid by the employer as per law the lawyers charges would be around 1000 dollars for some paper work.
My second H1B transfer costed be 1200 dollars as lawyers fee and all other charges has to be paid by the employer as per law.
Its best to get an immigration lawyer involved since you can have a peace of mind. There is no need of premium processing. Once you get the receipt you can join the other firm. You don't have to wait till the process gets completed.
