Currently on H1B 8th year extension which will expire on 25th June, 2009.
Labor PD: 9th August, 2004
Labor cleared: 11th September, 2007.
I-140 (approval pending) filed on 4th October, 2007. Received at USCIS on 5th October, 2007.
Can�t file for I-485 since the EB3 date for India is unavailable.
There is a high chance that I might be laid off at my current employer in the next 2-3 weeks.
Can I transfer my H-1 upto June 25th, 2009 (or later) as well as start a new PERM case in EB2 category?
In case of the above H-1 transfer, will the new H-1 be valid for 1 year from the filing or will it be upto 25th June, 2009?
What are my other options not to go out of status or leave the country?

What is the point of publishing dates for people to see if they have no relevance?
If they are just for CIS employees to see... why publish them publicly and confuse the deuce out of the entire immigrant community?

Friends,
I am on H1 right now. I got my H1 last year, Before that I was on OPT (F1). I didnt go to India after I got my H1 and I am employed since the H1 started (Oct 1,2007). I am planning to go to India now in dec. I heard that if you stay more than an year after getting H1 and without getting the passport stamped, I need to fill out an additional form before I got to the visa interview. Is this true??
Secondly, When I applied for H1, I applied thru company A. But even before the H1 started (which is Oct 1,2007) and as soon as my H1 (for company A) got approved (Sept 10, 2007) I applied for H1 transfer to company B. So I was on Company B's H1 from Oct 1,2007 (which is the actual start date of my H1). Now, would this pose a potential problem at the visa interview?

Hello,
I have few questions and seeking your advise on it. Currently I have a H1B and EAD with EB3 category GC application.
1. I am working on H1B for "X" company and they have filed extension for it. Now, I got an offer from "Y" company and they are willing to transfer my H1B.
Is there any problem for H1B transfer to the Y company while it is filed for extension from my current employer?
2. The new company "Y" is also going to file my new GC labor and I-140 as job has little different and senior role but similar to what I had in my previous H1B and GC labor in EB2 category.
Now, can my current employer "X" company remove I-140 or create any kind of problem for my immigration status, specially with GC?
Any information, you can provide will be really helpful.

Hi I'm a US citizen and have around 15k or less credit card debt. All government loans were paid off. Something happened three and a half years ago in my home town and I had to leave Washington state and took care of it. So my question is: it's has been 3 and a half year and I'm heading back to washington state for short visit.
1. I'm sure the debt did gall into collection agency. Will it go to court?
2. Since I had been gone since 2007 and will there be a warrant on me since I didn't appear to court (if there was one)
3. I will be entering Vancouver bc airport then to Seattle by driving. I'm afraid I will get caught for warrant at the border.
Hopefully someone can answer my questions and thanks for the help in advance.

I filed 485 last july and want to file EAD now. I had FP done last year. If I do efiling for EAD will I have to go to ASC for photos. I saw in other posts that they have linked Biometrics but what abt the photos ?

I received my green card a few months ago but my family haven't received their's yet. As a result they are still using EAD and/or Advance Parole documents. I am considering a job change and in that context I have two questions:
1. Are there any gotchas that I should be aware of - given that my family's cases haven't been approved yet.
2. If I do change jobs, can I apply for EAD and Advance Parole documents for my family on my own? Meaning, without going through the employer.

Also is it possible to request USCIS to change an EB2 I140 denied partition to EB3 during an appeal?

To get SSN, you need to go to SSA office and apply. It will take 2-4 weeks to get the card in mail. You think it is automatic to get after entry.

I am currently 29 yrs old. I have had my green card for 9 years now. However, I was arrest when i was in college at the age of 20, was convicted of a misdemeanor account of drug possession. Youth and stupidity some times does go hand in hand. :mad:
My question is this, should i apply for citizenship next year, GC expiring 2010. Or should I just extend GC. I have stay out of trouble ever since, not even a speeding ticket. I have turned my life around and currently a home owner. :rolleyes:
Does anyone know any case of a successful naturalization of a drug case that was none marijuana related? Any advice is greatly appreciated... thanks in advance!!;)

If i get you right, what you are asking is H1 to F1 conversion, why it is not possible ?
It is possible provided if one is maintaining his or her H1 status, till requesting to convert to F1.
