My friend John Lamb in Nashville has had this idea for a while. It sounds a little nuts at first, but as John notes - Giving American citizens the power of granting legal status to their foreign-born friends is an idea I've had for a while but not trumpeted very much. Hi All,
My wife is on H1 since Oct 2009. No paystubs. Now she want to come back on H4. Her H4 stamping expired. I have my H1 renewed in Oct 2009 and need stamping.
What are the best and low risk options to convert to H4 status. Please advice

I believe finger print needs to be obtained somehow to varify the person. Hope it is not damaged too much. Why dont you try to obtain a doctor's letter stating that she had some blisters and is recovering? Usually for ladies it shouldn't be much of an issue but just as a precaution. The POE officers are usually good towards Indian ladies, particularly when they travel alone. So dont worry too much.

Hi,
I am on EB2+PERM. I got LC approved and currently filed for I-140 and 485.
As I understand unless the I-485 is pending for more than 180 days after the approval of I-140, I have to restart the whole process again with the new employer (expect that I can port PD if I want to).
Now are there any chance that if the above scenario happens, and my employer did not revoke I-140 or 485, that I can still receive my GC? Or that will be illegal? Please clarify.

Just i have applied for AP through efile. From here what's the procedure? Do i need to send the support documentation? if so, what are all the documents i need to send? please through some light on this. also will i get another bio metrics appointment?

I am a strong supporter of Comprehensive Immigraton Reform (CIR). I have been on both sides of the fence. In the late 1970s and early 1980s, I was an attorney for the Immigration and Naturalization Service. Hi,
I've been working full-time on EAD for the last 2+ years. I have a pending 485 application, on which my spouse is the primary applicant. I have never applied for H1B in the past, because I transferred directly from F1 (student visa) to this EAD.
My spouse also has an H1B, which is in it's 7th year (completed 6 yrs of H1B).
My spouse has been put on furlough (unpaid leave) for 3 months.
What are our options ?
1. Can my employer file H1B for me, and an H4 for my spouse ? How will this affect our green card application (on which my spouse is primary applicant) ?
2. How much time does my spouse have to look for another job (with similar job description), without being out of status ? Is there some grace period associated with H1?

Should be pretty straight forward. Ask her to take the signed I-20, financial support docs, letter from the department, and also from advisor (if possible). Though in our case, the VO didnt ask for a single doc but its good to have them all.
