A few weeks ago, I posted a story written by one of our clients, a Registered Nurse from the Philippines employed by a hospital in the U.S., who was stopped and held by CBP officers as she and her family tried to drive north from their home in El Centro, California near the U.S.-Mexican border to Palm Springs to celebrate her husband's birthday. The entire family had pending applications for adjustment of status, but in a bizarre twist of fate, they were held by the CBP all day and threatened with criminal charges, incarceration and deportation. A major economic concern is how immigrants influence the wages and employment prospects of U.S. workers. The economic impacts of immigration vary tremendously, depending on whether immigrants are unskilled agricultural laborers, for example, or highly skilled PhD computer scientists. Although their consequences are often conflated, it is constructive to examine the impacts of low-skilled and high-skilled immigrants independently.
Is it possible for the administration to do a study on this matter through a commission - and take its recommendations to formulate the laws accordingly - and immediately? This takes away the usual BS that politicians from both side dish us?

Hi,
I applied for EAD renewal at NSC on 07/03/08 and today 08/06/2008, the status shows card production ordered. I applied for my wife along with me and her status shows still received.
Does the dependent (spouse) EAD in general get approved a few days after the primary applicants EAD is approved? I am not really using the EAD, its my wife who is using it, and thats the concern.

Hello,
Here is my situation :
1) Labor filed in EB3 in June 2004. The labor was filed in non-PERM and approved. I-140 was filed in Aug 2007 and it is approved in Dec 2008 with Priority date of June 2004
2) Labor filed in EB3 with same company in May 2006 through PERM. Got approved in 2 months and I-140 applied and approved within 12 months in April 2007. Priority date is May 2006. Applied for 485 in Aug 2007 and have EAD/AP based on it.
I am no longer with the company (quit after 180 days after 485 was applied) and am working for another company on H1B using AC21.
Question is, can I port priority date for 485 processing from May 2006 to June 2004 in my case where I have changed employer. Note that by time June 2004 I-140 is approved, I am no longer with that company.

Hello Attorney,
I filed AP for me and my Dependent , Unfortunately USCIS just picked the application on the top of packet ( My Application ) and i got the receipt No , I dont know what happened to my Spouces Application her check is not cashed and no receipt no , I suppose her applicaiton is was just placed with my applicaiton and was considered as just one application .
Now what are my options , can i go ahead and file one more application , i know its literally impossible for me to call uscis and Track my wife's application , can i go and file a new application for my Spouse . Please advice.

my I-485 is pending; PD is oct 05.
my Labor Cert shows that we use job description of programmer/analyst. ETA Case shows title as "Software Engineer"
I have a job offer in Information Technology, will there be any problems if I use AC21 with the new company?
I have not yet accepted the offer.

I have taken a 2 day stop over in Dubai while coming back to USA in April 2010. I booked my flight on Emirates. Emirates will sponsor my visa. But i am not sure now they allow Advance Parole as when i apply for visa one of the requirements says "Travel documents, such as re-entry permits and refugee documents are not permitted"

The annual Consumer Electronics Show kicks off this week in Las Vegas. This is the gadget wonderland I've attended for the last several years. Hi All,
I have I-140 with PD of 2004 from previous company. From the current company I had started new GC process.
a) Previous labor title is software engineer. New labor title is Computer support specialist.
b) New perm process just started and job order has been posted last month.
In the job order company didnt give much details and only one sentence which is related to the old labor job description though it has 8 lines describing the job description
c)Should the above be a problem for porting the PD? Also current company has not done the sunday ads. Can they include all 8 lines describing the job description in the sunday ads?
d)I am in Viriginia and which sunday news papers do you recommend(EB2)
category.
e) Is there any PERM filing fee ?

My friend Cyrus Mehta reports on a disturbing incident that occurred last week at Newark's international airport. Apparently CBP officers got hold of the new Neufeld memorandum on H-1B workers at third party work sites and decided to start applying it on their own. I just missed 120-90 day window for filing EAD. My EAD expires on oct 12 and today is July 12TH.
Other stats:
Have H1B active with current employer till Feb 2009
Just got my priority date current - EB2 July 2004 for India
I-140 approved, I-485 and I-140 filed last year receipt date Sept 2007
Questions:
How can I get new EAd now?
I can continune working on H1B correct?

Yes you can travel with H4 to US with your Wifes H1 and then transfer to H1 if its still vaild at the time of transfer.. Note you can also use your existing H1 as well, As per rule an H1 can be in the US for 6 years. if you have spent some time in between outside US that duration will not be counted in the 6 yrs. So calucate your exact number of days spent in US and if it exceds 6yrs then its not possible to use your existing H1. Note: the days spent on H4 will not be counted in 6 yrs but days spent on L1 will be counted.---
